These Terms and Conditions (“Terms”) govern your access to and use of the website and services provided by East Oak Estates (“we,” “us,” or “our”), a New Jersey–based property management company. By accessing or using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

1. Services and Scope

East Oak Estates provides property management services including, but not limited to, tenant intake and screening, rent collection, maintenance coordination, property inspections, and owner reporting. Specific services and fee arrangements for each client are set out in separate service agreements or work orders. These Terms apply to both users of the website and clients who contract with us for property management services, except where a separate written agreement supersedes these Terms.

2. Eligibility and Account Use

You must be at least 18 years old and legally able to enter into binding contracts to use our services. When creating an account or submitting information, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of any account credentials and for any activity that occurs under your account.

3. Maintenance Requests and Communications

Maintenance requests submitted through our website, email, portal, or by phone will be routed to our maintenance team or approved vendors. Submitting a request does not guarantee immediate action; response times depend on vendor availability, the nature of the request, and prior commitments. You agree to provide accurate details and, where requested, access to the property so vendors can perform work. Emergency maintenance should be reported according to the emergency procedures listed in your management agreement or as directed on our website.

4. Fees, Payments, and Billing

Fees for property management, maintenance, and other services are set out in your individual service agreement. Payment processing may be handled by third-party payment processors. You authorize us to charge your designated payment method for fees, invoices, and authorized expenses. Late payments may incur interest or late fees as specified in your agreement. We do not store full payment card details on our website; payment information is processed through secure third-party services.

5. Cancellations and Termination

Either party may terminate a service agreement in accordance with the notice and conditions stated in that agreement. We may suspend or terminate access to the website or services for violations of these Terms, fraudulent activity, or other conduct that we determine in good faith to be harmful to our business or other users. Termination does not relieve you of obligations accrued prior to termination, including payment of outstanding fees.

6. Intellectual Property

All content, trademarks, logos, designs, and materials on the website are the property of East Oak Estates or our licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works, or publicly display our content without our prior written consent, except as required to use the services as intended (for example, downloading invoices or forms for your records).

7. User Conduct

You agree not to use the website or services for unlawful purposes, to transmit harmful code, to harass or falsely represent others, or to interfere with the operation of the site. You agree to indemnify, defend, and hold harmless East Oak Estates and its officers, directors, employees, agents, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the website or services, your violation of these Terms, or your violation of any rights of another.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey without regard to its conflict of laws rules. Any dispute arising from or related to these Terms or the services will be resolved in the state or federal courts located in New Jersey. You and East Oak Estates consent to personal jurisdiction in those courts.

13. Changes to Terms

We may update these Terms from time to time. When material changes are made, we will post the updated Terms on our website with a revised effective date. Your continued use of the website or services after publication of changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Waiver

Failure by East Oak Estates to enforce any provision of these Terms will not be deemed a waiver of future enforcement of that or any other provision.
